Terms and Conditions

Agreement

These Terms and Conditions (“Terms”) govern your use of the Promptur platform, the Promptur recording app, promptur.com and related services (the “Service”), operated by 1001443613 Ontario Inc. (“Promptur”, “we”, “our” or “us”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use Promptur. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian.

Your Account

  • You are responsible for keeping your account secure and for all activity under it.
  • You agree to provide accurate information and keep it current.
  • We may suspend or close accounts that violate these Terms.

Business Customers

  • Business customers license Promptur per salesperson under a written order or proposal. Pricing, term and other commercial details are set out in that order or proposal.
  • If you use Promptur through a business customer, such as your employer, that business customer’s order or proposal with us also applies to your use. The business customer can add or remove your access.
  • A business customer can see activity data for its licensed users. For example, managers can see each salesperson’s activity.

In-App Purchases

Individual packs bought in the Promptur recording app are one-time purchases. They are processed by Apple under Apple’s terms, and refund requests are handled by Apple.

Your Content

  • Videos and recordings you make on your own personal device belong to you.
  • Content produced on equipment owned or provided by a business customer, such as a dealership’s own devices, belongs to that business customer.
  • Promptur does not claim ownership of any content. We receive only a limited, non-exclusive licence to host, process and display content as needed to provide the Service.
  • You are responsible for the content you record, save and share, including content you post to third-party platforms.
  • You agree not to use the Service to create or share content that is unlawful, harassing, defamatory, infringing or harmful.
  • Content you share to third-party platforms is subject to those platforms’ terms.

Our Content

The Promptur platform, the Promptur recording app, prompts, prompt packs, design and brand are owned by Promptur and protected by law. We grant you a personal, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, resell, scrape or redistribute our prompts or prompt packs.

Acceptable Use

  • Do not reverse engineer, disrupt or attempt to gain unauthorized access to the Service.
  • Do not use automated tools to access or extract content from the Service.
  • Do not use the Service in violation of any law.

Privacy

Our Privacy Policy explains how we collect and use your information.

Apple App Store

These Terms are between you and Promptur, not Apple. Apple is not responsible for the Service or its content. Your use of the Promptur recording app must also comply with the Apple Media Services Terms and Conditions. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that the Service will be uninterrupted or error-free, or that any content will achieve a particular result.

Limitation of Liability

To the fullest extent permitted by law, Promptur is not liable for any indirect, incidental, special or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount paid to us for your use of the Service in the 12 months before the claim.

Termination

You may stop using the Service at any time. We may suspend or end your access if you violate these Terms. A business customer’s access ends as set out in its order or proposal. Sections that by their nature should survive termination will survive.

Changes to These Terms

We may update these Terms. We will tell you about significant changes through the Service or by email. If you keep using the Service after the changes take effect, you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any disputes will be resolved in the courts of Ontario.
